I am the owner of a high-end beauty salon that has been open for half a year in Shanghai. Recently I have favored a South Korean salon-grade anti-aging cosmetic product, and want to directly contact the brand to become its domestic agent, exclusively supply the product to my own salon and three nearby cooperative small beauty salons for customer acquisition. But last month I heard from a peer that someone had their entire shipment detained by Pudong Airport Customs due to non-compliant import procedures, they were fined more than 100,000 RMB and their new product promotion schedule was completely disrupted. Now I am very anxious. I know nothing about the compliance requirements of import foreign trade, and I don't know whether I need to hire a professional agency company. I also don't know what qualifications are required for legal operation, and whether there are special regulatory requirements because it is a salon-grade product exclusively for beauty salons. If something goes wrong in the process, will my salon be implicated, inspected or even forced to suspend operation? I am really anxious and want to ask if this kind of agency operation is actually legal?

First of all, complete the core detail of **pre-audit of documents**: For beauty salons acting as agents of imported cosmetics,it is necessary to confirm in advance whether the product has obtained the Imported Cosmetics Record Certificate (for non-special use cosmetics) or Administrative Approval Document for Imported Special Use Cosmetics issued by the National Medical Products Administration of China. At the same time, require the brand to provide certificate of origin, sanitary certificate, ingredient test report and other documents, ensure that document information 100% matches the actual product, and eliminate common improper industry practices such as unauthorized use of others' certificates and altered documents.
Notes for connection of core nodes: Select an enterprise with formal foreign trade agency qualification to handle customs clearance, ensure that the operating unit and consignee on the customs declaration match the actual operating entity. After customs clearance is completed, complete the clearance formalities at the customs electronic port in time, and simultaneously record product information into the beauty salon's operating account,to achieve the unification of "documents, goods and accounts".
Contingency plans for abnormal situations should be formulated in advance: If the cargo is selected for inspection by customs, provide a complete document chain immediately to cooperate with the inspection,If the cargo is detained due to inconsistent ingredient labeling, contact the brand immediately to supplement the official ingredient description,or entrust a professional institution to conduct re-testing,If the approval document expires, complete the renewal of the approval document before the cargo arrives at the port,to avoid additional costs caused by port detention.
Final compliance implementation: All imported cosmetics must display their record number in a prominent position in the beauty salon, and no one may alter product packaging or promotion content without authorization. At the same time, retain all import documents for at least 5 years for spot inspection by market supervision authorities,to ensure the whole process is legal and compliant.

In the customs declaration link of imported cosmetics for beauty salon agency, it is necessary to focus on accurate classification of commodity codes. If salon-grade cosmetics are incorrectly classified into ordinary daily chemical products, it will trigger customs valuation disputes and even lead to declaration deletion and re-declaration. When declaring, clearly mark "exclusively for salon use in beauty salons" in the remark column, and submit the Imported Cosmetics Record Certificate as an accompanying document, to ensure that the product name, specification and ingredients on the customs declaration are completely consistent with the recorded information. If you encounter customs valuation queries, you need to provide the authentic purchase contract between the brand and the agent, payment voucher and international logistics bill of lading, to form a complete closed price logic, avoid cargo detention at the port due to inconsistent valuation.

For imported cosmetics exclusively for beauty salons, the logistics route should prioritize direct flights to Shanghai Pudong Airport, to avoid increased title risk caused by transshipment. After the cargo arrives at the port, customs clearance must be completed within the free storage period (usually 7 days). If customs clearance is not expected to be completed on time, apply to the shipping company for an extension of the free storage period in advance, to avoid container detention fees. When picking up the cargo, check that the endorsement information on the bill of lading matches the qualification of the consignee, and check the authenticity of the seal on the cargo packaging, to ensure that the cargo has not been replaced during transportation. If the cargo needs to be distributed to multiple cooperative beauty salons, use enclosed van trucks for transportation, retain distribution accounts and signing receipts, to ensure cargo title is controllable throughout the whole process.

For beauty salons acting as agents of imported cosmetics, you can apply for the **VAT Deferral** policy to reduce capital occupation costs. You need to submit the deferral application to the tax authority before customs clearance, to ensure that import value-added tax does not need to be paid immediately, and is declared and paid after the product is sold. At the same time, it should be noted that the purchase cost of imported cosmetics must include tariffs, consumption tax and value-added tax, these taxes should be reasonably included in product pricing, to avoid profit loss caused by cost calculation errors. If there is a related party transaction with an overseas brand, ensure that the transaction price complies with the arm's length principle, to avoid triggering BEPS investigation and incurring additional tax risks.

In the payment and settlement link of imported cosmetics agency, payment should be completed through the CIPS RMB Cross-border Payment System, to ensure that the payment amount is completely consistent with the cargo value on the purchase contract and customs declaration, avoid violations such as overpayment and underpayment. If the brand requires receiving payment through an offshore account, submit a certificate of legality of the offshore account to the bank in advance, to ensure that the payment and settlement process complies with the regulations of the State Administration of Foreign Exchange (SAFE). At the same time, retain all payment and settlement vouchers for at least 5 years for spot inspection by SAFE. If you are subject to a payment and settlement inspection by SAFE, provide purchase contracts, customs declarations, logistics bills of lading and other documents in time, to form a complete payment and settlement logic chain.

When a beauty salon signs an agency contract with an overseas brand, the product compliance liability clause must be clearly agreed, requiring the brand to ensure that the product complies with China's cosmetic regulatory requirements. If the cargo is detained or fined due to incomplete product qualifications, the brand shall bear full responsibility. At the same time, add an intellectual property protection clause, clearly stating that the brand owns the intellectual property rights of the product such as trademarks and patents, to avoid product removal or legal disputes caused by infringement. If it is necessary to sign an exclusive agency agreement, clearly define the agency area, term and liability for breach of contract, to avoid the situation that the brand breaches the contract and authorizes other agents.

If imported cosmetics are selected for inspection by customs after arrival at the port, you need to cooperate with on-site inspectors to complete unpacking inspection, prepare product ingredient test reports, record certificates and other documents in advance for inspectors to check. If the machine inspection shows abnormality, proactively apply for manual inspection, and explain to the inspector that the product is salon-grade cosmetics, to avoid misjudgment as dangerous goods due to special packaging. If the product needs to be sent for inspection and identification, cooperate with customs to complete sample collection, and follow up the identification progress. If the identification result is consistent with the declared information, customs clearance can be completed quickly; If there is a discrepancy, contact the brand in time to supplement supporting documents, or apply for declaration deletion and re-declaration.

Most imported salon-grade cosmetics are glass-bottled or contain high-activity ingredients, so cushioning packaging materials meeting UN standards must be used, to avoid damage during transportation. At the same time, according to the product's MSDS, select a moisture-proof and light-proof packaging scheme, to ensure that product ingredients do not deteriorate during transportation. If the product is a refrigerated cosmetic, use temperature-controlled container transportation, set an accurate temperature range (usually 2-8℃), and mark the temperature control label on the packaging, to avoid detention during customs inspection due to temperature non-compliance. The Chinese label on the packaging must be printed in advance, to ensure that the label content complies with China's cosmetic label regulations, and avoid customs clearance delay caused by non-compliant labels.

For beauty salons acting as agents of imported cosmetics, the small-batch multi-frequency procurement strategy should be adopted to reduce the risk of inventory backlog. At the same time, according to the sales data of the store and cooperative beauty salons, formulate an accurate linked inventory strategy, to ensure that product supply matches sales demand. FOB Shanghai is the preferred trade term, the agent is responsible for domestic logistics and customs clearance, to control cargo title and logistics costs. At the same time, establish a cost actuarial model, include tariffs, logistics fees, agency fees and other costs into product pricing, to ensure a reasonable profit margin for the product. If market demand increases, the procurement batch can be gradually increased, and negotiate a more favorable procurement price with the brand to improve the overall return ratio.
