I am a small and medium-sized custom home furnishing exporter based in Shanghai. Last month, I just received a large Christmas order from a European client, but my previous cooperating logistics agent dumped my containers twice, which not only delayed the shipping schedule but also incurred nearly 20,000 yuan in port detention fees. The client has already sent a claim letter, and I am now so anxious that I can’t sleep. This time, I want to find a reliable logistics agent that can ensure stable shipping space for European routes, control logistics costs, and help me handle customs declaration, inspection and other trivial matters to avoid further troubles. But I haven’t seriously screened agents before, and now facing a bunch of agents with uneven quotations online, I have no idea where to start, fearing to step into another pitfall. Could you give me some practical suggestions?

Many exporters fall into two core pitfalls when looking for logistics agents: first, only focusing on low quotations while ignoring the agent’s qualifications and service capabilities, second, blindly choosing large industry-leading agents, thinking that the bigger the better.
If you fall into the first pitfall, you will most likely encounter situations where the agent resells shipping spaces or charges hidden fees, and even have your goods detained due to the agent’s incomplete qualifications. Later, you will not only have to pay high customs fines but also trigger customer claims. The port detention loss you suffered this time is just the first step of a chain reaction,if you choose a large agent that does not value small and medium-sized orders, your goods will be given low priority, and container dumping and delays will still be common.
Verifying three core qualifications first: First, hold a Non-Vessel Operating Common Carrier (NVOCC) qualification, second, have first-class agent authorization for the target route, third, have no major customs penalty records in the past three years. You can verify this through the official website of the Ministry of Transport and the Customs Credit Publicity System.
Sign clear demurrage compensation clauses, agree on the compensation ratio and time limit for container dumping and port detention, and lock in alternative agent resources in advance. If the main agent has shipping space issues, you can switch to the alternative plan within 48 hours. Exclusive risk-mitigation tip: Ask the agent to provide a shipping space confirmation letter before arranging goods to be put into the warehouse,to avoid extra costs from running to the warehouse for nothing.

When looking for a logistics agent, be sure to check the compliance capability of their customs declaration team, focusing on confirming whether they have agent customs declaration qualifications and experience in customs pre-classification filing for the corresponding export country. If the agent makes mistakes in the customs declaration process, such as incorrect HS code classification, it will directly lead to cargo detention, not only incurring port detention fees but also triggering customs valuation disputes and extending the customs clearance cycle. It is recommended to ask the agent to provide samples of customs declaration forms for the same category of goods in the past 6 months, check the accuracy of HS codes and declaration elements, and clarify the compensation liability for declaration errors in the entrustment agreement to avoid affecting export tax rebates due to declaration issues.

For European route shipping demand during the Christmas season, when screening logistics agents, focus on their shipping space locking capability. Prioritize first-class agents that have signed space charter agreements with shipping companies such as Maersk and Mediterranean Shipping Company (MSC). Such agents can ensure shipping space stability, with a container dumping rate more than 60% lower than second-class agents. At the same time, confirm the agent’s cargo right control process, and ask them to provide a full-process cargo right tracking system to ensure that you can grasp the cargo right status in real time before the goods arrive at the port, avoiding the risk of the agent secretly reselling the goods. In addition, clarify the application authority for free detention period and container demurrage fees, and apply for extended free detention periods at European ports in advance to reduce port detention costs.

If your goods are shipped via European routes, when choosing a logistics agent, pay attention to whether they can cooperate in implementing the VAT deferral policy. Some small agents are not familiar with VAT deferral operations, which will cause you to pay import VAT in advance, tying up your cash flow for 3 to 6 months. It is recommended to ask the agent to provide cases of compliant VAT deferral operations, check whether they can accurately provide logistics documents for VAT deferral declaration, and clarify in the entrustment agreement that the agent needs to assist in handling logistics materials related to tax investigations, to avoid failure of VAT deferral applications due to inconsistent logistics documents and resulting extra tax costs.

When screening logistics agents, confirm whether they have the compliance cooperation capability for cross-border receipts and payments, especially experience in CIPS RMB cross-border payment operations. If the agent cannot provide accurate logistics bills of lading, manifest and other documents, it will affect your RMB settlement through the CIPS system, and even trigger bank compliance inspections, resulting in delayed settlement. It is recommended to ask the agent to provide samples of logistics documents connected to the CIPS system, check the consistency of document numbers, cargo values, and consignor and consignee information, and confirm that the agent can provide manifest information within 24 hours after the goods are loaded, to ensure smooth receipts and payments.

When signing an entrustment agreement with a logistics agent, focus on improving two clauses: first, the scope of force majeure clause, clarifying that container dumping and delays caused by the agent’s own mistakes do not fall under force majeure, and the agent shall bear full compensation liability; second, clear agreements on cargo right transfer, requiring the agent not to endorse and transfer the bill of lading to a third party before receiving your written notice. At the same time, ask the agent to provide a bank guarantee as performance security for compensation, to avoid the agent being unable to pay the claim due to financial problems. In addition, check the validity period of the agent’s business license, tax registration certificate and other qualifications, to avoid cooperating with agents with expired qualifications.

When looking for a logistics agent, confirm whether they have emergency response capabilities for on-site inspection, especially experience in handling inspections for European routes. Some agents cannot provide professional on-site support when their goods are inspected, which will extend the inspection time and incur high container demurrage fees. It is recommended to ask the agent to provide inspection handling cases from the past 3 months, check whether they can quickly provide cargo descriptions, test reports and other materials that meet customs requirements, and confirm that they have cooperating on-site inspection service providers at European ports that can arrive to assist in handling within 2 hours after receiving the inspection notice, to reduce the impact of inspection on timeliness.

When screening logistics agents, pay attention to whether the logistics documents they provide meet the compliance requirements for export tax rebates, focusing on checking the consistency of information on bills of lading, manifests and customs declaration forms, including cargo names, quantities, weights, consignor and consignee information, etc. If the logistics documents are inconsistent with the customs declaration form, it will trigger tax investigations, even leading to the failure of export tax rebate declarations and loss of tax rebate amounts. It is recommended to require the logistics documents provided by the agent to be stamped with the company’s official seal, and clarify in the entrustment agreement that the agent needs to cooperate in providing relevant logistics materials for tax investigations, to avoid affecting the tax rebate progress due to logistics document issues.
